Success Highlight: EB-2 NIW Approval for Writer from Taiwan

On May 26, 2023, LPY Law Group received approval of an EB-2 National Interest Waiver (NIW) I-140 immigrant petition for a poet, essayist and creative writer in literature from Taiwan. The United States Citizenship and Immigration Services (USCIS) approved the petition without RFE.

For EB-2 I-140 immigrant petitions, the petitioner must show that she is either an advanced degree professional or possesses exceptional ability in the sciences, arts, or business. For most EB-2 I-140 petitions, she must also have a permanent US job offer and an approved labor certification. However, a National Interest Waiver or NIW waives the requirements of a permanent US job offer and an approved labor certification if the petitioner can show that her entry into the US as a permanent resident is in the national interest.

Our client has the U.S. equivalent of an M.A. in Social Research and Culture Studies. Evidence of her achievements and significant contributions to the arts included a series of books and other literary works (poems, prose, and essays) that she authored and were published in prestigious forums, English translations of her works, and the national or international grants and awards the client’s work has received. Demonstrating the recognition of her achievements and contributions, evidence was submitted of the invitations for her readings or lectures around the world. In addition, evidence was presented of the various media reports about the client and her work, along with editorials and critiques of her literary works.

Based on the substantive evidence, we were able to successfully argue that our client would serve the national interest by providing readers and listeners of her work new viewpoints not previously considered, especially viewpoints from minority groups, thereby advancing positive change in cultural growth, acceptance, and understanding. The U.S., as a nation of immigrants, has attracted a good number of literary talents from all over the world who have made American literature as great as it is today --- Vladimir Nabokov, Ha Jin, Khaled Hosseini, just to name a few.
