LPY Law Group Obtains NIW Approval for a Poet

On June 6, 2018, LPY Law Group received approval of an EB-2 National Interest Waiver (NIW) I-140 immigrant petition for a poet, writer, editor and educator in creative writing from Taiwan. The United States Citizenship and Immigration Services (USCIS) approved the petition without RFE.

For EB-2 I-140 immigrant petitions, the petitioner must show that he is either an advanced degree professional or possesses exceptional ability in the sciences, arts, or business. For most EB-2 I-140 petitions, he must also have a permanent US job offer and an approved labor certification. However, a National Interest Waiver or NIW waives the requirements of a permanent US job offer and an approved labor certification if the petitioner can show that his entry into the US as a permanent resident is in the national interest.

Our client has an M.F.A. degree in Creative Writing from a US university. Evidence of her achievements and significant contributions to the arts included a series of poems, broadsides, and a chapbook that she authored and were published in prestigious forums as well as translation works in which she served as translator for well-known media and highly regarded poets. She also gave invited performances at numerous artistic exhibitions and public readings on a national and international scale. Demonstrating the recognition of her achievements and contributions, evidence was submitted of the invitations she received to provide literary works for publication, to provide editorial services for poetry publishers, to participate in artistic exhibitions and public readings, to be a guest speaker, to be interviewed by media, and to license the rights of her work. In addition, evidence was presented of the various media reports about the client and her work in media throughout the US.

Based on the substantive evidence, we were able to successfully argue that our client would serve the national interest by providing readers and listeners of her work new viewpoints not previously considered, thereby advancing positive change in cultural growth, acceptance and understanding. The U.S., as a nation of immigrants, has attracted a good number of literary talents from all over the world who have made American literature as great as it is today --- Vladimir Nabokov, Ha Jin, Khaled Hosseini, just to name a few.
